Colorado’s Producer Responsibility Advisory Board will hold its 61st meeting virtually on April 8, 2026 from 12:30 p.m. to 2:30 p.m. Stakeholders and members of the public are welcome to observe the meeting, and provide public comment. During this business meeting, we will announce Circular Action Alliance’s new appointee to the advisory board, and we will discuss current advisory board vacancies. Afterwards, Interchange 360 and Circular Action Alliance will provide implementation updates. The board will then discuss scheduling for the upcoming 2026 board meetings, including whether or not to extend the June, July and August meetings from two hours to three hours. The meeting agenda will be made available on the Producer Responsibility Advisory Board webpage along with meeting materials and recordings from prior meetings. Stakeholders and members of the public are welcome to attend. The department considers all public comments, so members of the public are strongly encouraged to provide their feedback. This is your opportunity to make your voice heard and participate in the implementation of this program! Rulemaking update The Solid Waste and Materials Management Program of the Colorado Department of Public Health and Environment is proposing changes to Section 1.8.2 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1. We are required to annually adjust by rule the dollar limitation for realized gross total revenue of producers that are exempt from the requirements of the producer responsibility program under 25-17-7 C.R.S. These adjustments are based on the U.S. Bureau of Labor Statistics local consumer price index (CPI). We will host a virtual stakeholder meeting on the draft of the proposed rules on April 6, 2026, from 10:00 a.m. to 11:00 a.m. to discuss the updated draft regulations and gather input. Stakeholders and members of the public are welcome to observe the meeting and provide public comment. The meeting will include Spanish interpretation. Producer requirements As required by the Producer Responsibility Act, a producer shall not sell or distribute products that use covered materials in the state unless the producer is participating in the program as of July 1, 2025. If a producer is found to be in violation of the requirements of the Act and regulations, the Department is authorized to issue an administrative penalty order with noncompliant producers. Producers can register and submit required reporting information with CAA and Interchange 360. Interchange 360 Collection Program Launched March 11 In preparation for operational launch in Colorado, Interchange 360 has been working with producers, service providers, and return collection facilities to establish the infrastructure needed to collect and recycle petroleum and automotive packaging across the state. The Interchange 360 program will support the responsible management of materials such as used motor oil containers, antifreeze containers, and similar packaging commonly generated through vehicle maintenance. Following launch, Interchange 360 will begin rolling out education and outreach resources to help Coloradans understand what materials are included in the program and where they can be properly returned for recycling. Open Market Recycling Reimbursement Process, Compost Funding Coming Soon Private and nonprofit recycling collectors that offer residential recycling services in Colorado may be eligible for reimbursement under the state’s Extended Producer Responsibility (EPR) law. Beginning in April, open market (subscription-based residential) collectors interested in participating in the program will be asked to submit a simple interest form and short service profile. Circular Action Alliance (CAA) Colorado will also share details on the compost funding process.
