On August 14, 2025, CDPHE’s executive director received the Colorado Producer Responsibility Advisory Board’s recommendation memo for Circular Action Alliance's (CAA) amended Program Plan proposal. Beginning on August 15, 2025, the Colorado Department of Public Health and Environment (the Department) began accepting public comments on the plan. The public comment period was open for 30 days, ending on September 15, 2025.

As per HB22-1355, with CDPHE in receipt of the board’s recommendation and comments from the public, the executive director will have one hundred and twenty days (until December 12, 2025) to approve or reject the Program Plan. If the executive director rejects the plan, the reason must be based on the failure of the document to comply with the requirements of HB22-1355.

Based on all public comment received, we have finalized our formal letter to CAA outlining our required changes to the Program Plan. This letter, along with a summary of our responses to all public comments received are available on our Producer Responsibility webpage.
